How to Claim DTAA Relief — Step by Step
- 1
Determine your NRI status
Count India days (April 1–March 31). Under 182 days = likely NRI. This determines whether India taxes your worldwide income or only India-source income.
- 2
Get a Tax Residency Certificate (TRC) from Japan
Visit your local 税務署 (Zeimusho) with your 在留カード and latest tax return. Request the certificate for tax treaty purposes. Free, takes 2–4 weeks.
- 3
File Form 10F in India
File Form 10F electronically on incometax.gov.in (need PAN). Provide the filed form to your Indian bank, tenant, or income source so they apply the DTAA-reduced TDS rate.
- 4
Claim reduced TDS or foreign tax credit
Indian payer applies DTAA rate (e.g., 10% for interest instead of 30%). In Japan, claim a foreign tax credit on your Japan tax return (確定申告) for India taxes already paid.
- 5
File India ITR if required
If India-source income exceeds ₹2.5 lakh, file ITR. Include Form 67 to claim credit for Japan taxes on income also taxable in India.
